1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Harken, a feedback collection platform operated by Cone Crows LLC ("we," "us," or "our"). By creating an account or using our service, you agree to be bound by these Terms.

If you are using Harken on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Harken. By using our service, you represent that you meet these requirements.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or negatively impact our service or other users.

4. Your Data

You retain ownership of all feedback data collected through your applications using Harken. We claim no intellectual property rights over your content.

You grant us a limited license to store, process, and display your data solely to provide the Harken service to you. This license ends when you delete your data or close your account.

You are responsible for your use of data collected through Harken, including compliance with applicable privacy laws and regulations.

5. Acceptable Use

You agree not to use Harken to:

  • Violate any applicable laws or regulations
  • Collect sensitive personal information (health, financial, etc.) without appropriate safeguards and consent
  • Distribute malware or interfere with the operation of our service
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the service in any way that could harm minors
  • Resell or redistribute the service without our permission

6. Subscriptions and Payment

Harken offers free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees incurred.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods.

We reserve the right to modify pricing with 30 days notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice for material changes that affect your use.

8. Disclaimer of Warranties

HARKEN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be error-free, secure, or available at all times.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONE CROWS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF HARKEN SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Cone Crows LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of Harken, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Alabama.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Harken console. Your continued use of Harken after changes become effective constitutes acceptance of the updated Terms.
